Recruiters representing candidates may not send that candidate's resume in response to a job posting. Deleting or changing another persons' information posted on the Site. Posting or transmitting any message, information, data, text, software or images, or other material that may invade another's privacy or publicity rights or is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous ,or otherwise objectionable. Using any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site. Taking any action that imposes an unreasonable or disproportionately large load on this Site's infrastructure. Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Site other than the search engine and search agents available on this Site and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer). Reference to any product, process, publication, service or offering of any third party by trade name, trademark, manufacturer or otherwise does not necessarily constitute or imply its endorsement or recommendation by AdultStaffing. The views and opinions of employers, candidates and other users of this Site do not necessarily state or reflect those of AdultStaffing. Adult Staffing is an internet posting board. All employment postings or other offers are posted by the advertiser alone, without assistance from Adult Staffing. These postings are not read, edited, critiqued or screened in any way, whatsoever, and appear on the board exactly as they were created by their authors, the advertiser.

Adult Staffing assumes no responsibility for the use of their posting board by any advertiser to assist them in committing any illegal activity whatsoever. All reasonable care should be taken when answering any classified ad in any media. Adult Staffing assumes no responsibility for the outcome of, or any negative result arising from any meeting or relationship that occurs as a result of any party answering any ad posted on this board.

Likewise, advertisers should exercise the same care in regards to ad respondents. Adult Staffing assumes no responsibility for the outcome of, or any negative result arising from any meeting or relationship that occurs as a result of their dealings with any party answering any of their ads posted on this board.

NOTICE AND TAKE DOWN PROCEDURES

AdultStaffing.com implements the following "notice and takedown" procedure upon receipt of any notification of claimed infringement. AdultStaffing.com reserves the right at any time to disable access to, or remove any material or activity accessible on or from any Site or any Materials claimed to be infringing or based on facts or circumstances from which infringing activity is apparent. It is the firm policy of AdultStaffing.com to terminate the account of repeat copyright infringers, when appropriate, and AdultStaffing.com will act expeditiously to remove access to all material that infringes on another's copyright, according to the procedure set forth in 17 U.S.C. §512 of the Digital Millennium Copyright Act ("DMCA"). AdultStaffing.com's DMCA Notice Procedures are as follows:

(1) The owner of a copyright must inform AdultStaffing.com's Designated Agent in writing of the infringement, meeting the criteria listed in Paragraph XV and §512 of the DMCA, which are:

(a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

(b) description of the copyrighted work or other intellectual property that you claim has been infringed, or a representative list of infringing works if multiple works on a single site are on one notice;

(c) a description of where the material that you claim is infringing is located on a Site;

(d) your address, telephone number, and email address where you can be located;

(e) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

(f) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf;

(2) If the notice does not comply with Paragraph XV and §512 of the DMCA, but does comply with three requirements for identifying sites that are infringing according to §512 of the DMCA, AdultStaffing.com's Designated Agent shall attempt to contact or take other reasonable steps to contact the complaining party to help that party comply with the notice requirements;

(3) When AdultStaffing.com's Designated Agent receives the notice, it will expeditiously remove and/or disable access to the infringing material and shall notify the affected user;

(4) Then, the affected user may submit a counter-notification to AdultStaffing.com's Designated Agent containing a statement made under penalty of perjury that the user has a good faith belief that the material was removed because of misidentification of material; and

(5) After AdultStaffing.com's Designated Agent receives the counter-notification, Deluxe Pass will replace the material at issue within 10-14 days after receipt of the counter-notification unless AdultStaffing.com's Designated Agent receives notice that a court action has been filed by the complaining party seeking an injunction against the infringing activity. AdultStaffing.com's reserves the right to modify, alter or add to this policy, and all users should regularly check back to these Terms and Conditions to stay current on any such changes.
